Petition to the Minister of Justice

Whereas:
  • Raising children requires an enormous amount of parenting time;
  • The Divorce Act is discriminatory regarding parenting time for parents who are separated and do not have shared custody;
  • A fit, non-custodial parent can decide, legally and unilaterally, how to use their parenting time and whether to spend any time at all with their children, and without the custodial parent having any recourse;
  • This is harmful for the children (abandonment, psychological trauma) and the custodial parent (lack of time for work, family activities, rest, exposure to abuse, in a situation of servitude); and
  • This exacerbates difficulties and poverty among single-parent families.
We, the undersigned, Canadian citizens, call upon the Minister of Justice to amend the Act respecting divorce and corollary relief by including the following rules:
1. That the parenting time allocated for a fit, non-custodial parent be mandatory;
2. That the parenting time for a fit, non-custodial parent be at least 10% of total annual parenting time, that is, 37 days that cover a 24-hour period;
3. That each day where a fit, non-custodial parent fails, either voluntarily or involuntarily, to fulfill their parenting time, they compensate the custodial parent by providing 5% more in monthly child support;
4. That the custodial parent can require shared custody without having to justify themselves, as long as the well-being of the children would not be at risk; and
5. That parenting include the obligation to spend parenting time with children regardless of the availability or willingness of the parents.
